1. Acceptance of Terms

By downloading, installing, or using the Cal Voice mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.

2. Description of Service

Cal Voice is a voice-powered AI calorie and workout tracking application designed to help users monitor their nutrition, track physical activities, and work toward their health and fitness goals. The App provides:

• Voice-activated meal and calorie logging
• Workout and activity tracking
• AI-powered nutrition coaching and recommendations
• Progress tracking and analytics
• Goal setting and monitoring features

3. Eligibility

You must be at least 13 years old to use Cal Voice. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

5. Subscriptions and Payments

5.1 Free and Premium Features

Cal Voice offers both free and premium subscription features. Premium subscriptions provide access to additional features and functionality.

5.2 Billing

Subscriptions are billed through your Apple App Store or Google Play Store account. By subscribing, you authorize us to charge your account on a recurring basis until you cancel.

5.3 Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

5.4 Price Changes

We reserve the right to change subscription prices. You will be notified of any price changes in advance, and changes will apply to your next billing cycle.

6. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality or servers
• Transmit viruses, malware, or other harmful code
• Impersonate any person or entity
• Harvest or collect user information without consent
• Use the App to send spam or unsolicited communications
• Reverse engineer, decompile, or disassemble the App

7. Health and Medical Disclaimer

IMPORTANT: Cal Voice is designed for general fitness and nutritional tracking purposes only. The App is NOT a medical device and should NOT be used as a substitute for professional medical advice, diagnosis, or treatment.

• Always consult a qualified healthcare provider before starting any diet, exercise, or wellness program.
• Calorie estimates and nutritional information are approximations and may not be completely accurate.
• AI coaching recommendations are for informational purposes only and are not medical advice.
• If you experience any adverse health effects, discontinue use and consult a healthcare professional.
• Do not disregard professional medical advice based on information from the App.

8. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio, software, and the overall design, are the exclusive property of Cal Voice and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. User Content

You retain ownership of any content you submit to the App (e.g., meal logs, voice recordings, profile information). By submitting content, you grant Cal Voice a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content to provide and improve our services.

You are solely responsible for the content you submit and represent that you have the right to grant this license.

10. Third-Party Services

The App may integrate with third-party services (e.g., Apple HealthKit, Google Fit, payment processors). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAL VOICE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH, ARISING FROM YOUR USE OF THE APP.

13. Indemnification

You agree to indemnify, defend, and hold harmless Cal Voice and its affiliates from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

14. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall survive.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of California.
